Agency Center

The Virginia Association of Realtors® worked to help develop legislation to enhance the agency relationship disclosure requirements between licensees and those they represent. This means there are a number of changes to the existing agency laws in Virginia, and VAR wants to make sure that all members are up to speed on what they need to know to serve their clients and customers and stay in compliance with Virginia laws.

Check out the video library on Agency law changes. This library is growing, so check back often!

VREB GUIDANCE DOCUMENT ON WRITTEN BROKERAGE AGREEMENTS

At its meeting September 6, the Virginia Real Estate Board approved the “Guidance Document on the Necessity of Brokerage Agreements” to clear up some confusion among licensees as to when a written brokerage agreement is required pursuant to the July 1, 2012, changes in Virginia agency law.

ADDED NOVEMBER 1: Sample e-mail to prospective buyers referencing VAR's "REALTOR®'S ROLE" piece (cut and paste the sample below into an e-mail)

Dear ______________,

Thank you for contacting me regarding the property at ______________________.  I would be more than happy to arrange a time when we could meet so I could show you the home. Please e-mail me your schedule or send me your phone number and I will call you.

By the way, when we meet I’m probably going to need you to sign what’s called a buyer-broker agreement. It's a contract required by a new Virginia law that spells out how I’ll help you find a home.

I know it might seem odd to have to sign something right away, but every Realtor® you work with will ask you to. It’s the law these days.

If you want more information, the Virginia Association of Realtors® has a very good explanation on its website: www.VARealtor®.com/agency-information-for-consumers. And I’ll be happy to explain it to you in person.
